Terms of use

1. Purpose

These terms govern the use of the LSKSoft client portal ("the portal"). They apply to anyone who creates an account or accesses it: clients, their team members and consultants.

They supplement the contract signed between LSKSoft and the client, which prevails in case of conflict.

2. Access and accounts

The portal is intended for businesses. An account is created by signing up, once the e-mail address is confirmed, or by invitation from an organization's owner or from LSKSoft.

Each account is personal. Keep your password confidential and tell us without delay about any unauthorized use. Two-factor authentication is recommended; it is mandatory for LSKSoft administrators.

An organization's owner can invite colleagues, suspend their access and choose whether they see invoices.

3. Services

The portal lets you follow your externalized team and its availability, read the CVs of assigned consultants, find your invoices, send requests (new profile, fixed-price project, team change) and estimate a cost with the simulator.

Invoices are prepared and issued by LSKSoft from the portal, then e-mailed to the client; the portal keeps them and tracks their status. An invoice prepared outside the portal can be uploaded to it.

4. Prices and simulator

Amounts shown by the simulator and estimates are indicative. Only LSKSoft's written proposal and the signed contract bind the parties.

Prices are shown without VAT: LSKSoft's services are exports of services, outside the scope of Tunisian VAT (Tunisian VAT Code, art. 3 and 11). For a client established in the European Union, any VAT is self-assessed by the client (reverse charge).

5. Consultants

Consultants remain employees or partners of LSKSoft, which organizes their work and approves their leave. The client is informed of absences in the portal, without any approval power.

The CVs presented are confidential: they are used only to evaluate and follow the assignment and are not passed on to third parties.

6. Uploaded documents and content

Documents you upload (specifications, PRD, attachments) remain your property. You grant LSKSoft the right to use them to study and handle your request, and you guarantee you hold the necessary rights.

If you ask, a non-disclosure agreement is signed before your project is studied.

7. Prohibited use

It is forbidden to try to access another organization's data, bypass security measures, extract content in bulk, upload malicious files or use the portal for unlawful purposes. LSKSoft may suspend or delete an account that breaks these rules.

8. Availability and liability

LSKSoft strives to keep the portal available at all times but cannot guarantee it: interruptions may occur for maintenance or in case of incident.

To the extent permitted by law and unless the contract provides otherwise, LSKSoft is not liable for indirect damage arising from the use of the portal.

9. Personal data

The processing of your data is described in the privacy policy.

10. Changes

LSKSoft may change these terms. In case of a significant change, users are informed in the portal or by e-mail before it takes effect.

11. Governing law

These terms are governed by Tunisian law. Any dispute about their interpretation or performance falls under the jurisdiction of the courts of Tunis, subject to the contract signed with the client and to applicable mandatory provisions.
